Employer-Tied Karta Pobytu in Poland — 2026

What it means when your karta czasowego pobytu is tied to a specific employer in Poland in 2026. When you cannot change jobs, what to write in Załącznik nr 1, how to switch employers without losing your residence permit. Annulment, appeals.

A karta czasowego pobytu issued on the basis of "employment with a Polish employer" carries, in 2026, an entry naming a specific NIP and pracodawca. This means that changing employers without proper notification of the voivode turns your karta from a valid residence permit into an "empty card" — one that authorises neither work nor a stay in Poland beyond the visa-free period. Below: how the "employer attachment" actually works, what to do when changing jobs, and the pitfalls most commonly encountered in Mazowieckie in 2026.

What "Tied to Employer" Actually Means

A karta czasowego pobytu on the basis of praca (Ustawa o cudzoziemcach, art. 114) is issued for specific work, with a specific employer, in a specific position. The plastic card itself shows:

  • Stanowisko (position) — for example, "kierowca samochodu ciężarowego" or "specjalista IT"
  • Pracodawca — legal entity name + NIP
  • Wymiar czasu pracy — full-time, half, quarter, etc.
  • Wynagrodzenie minimalne — the minimum salary stipulated by the contract

All of these parameters are "istotne elementy zezwolenia" — essential elements of the permit. Changing any of them without notifying the voivode is a formalnie nieprawomocne use of the karta pobytu. The card is in your wallet, but legally it does not cover your new work.

In 2026 in Mazowieckie, new rules apply (under the amendments to the Ustawa o cudzoziemcach effective 1 December 2025): a salary increase with the same employer in the same position no longer requires notification, but every other change does.

When Employer Attachment APPLIES

Employer attachment exists not for every karta pobytu — only for certain types:

If you hold a karta czasowego pobytu on the "praca" basis (the most common case), employer attachment applies. CUKR, family, business, or study — no attachment.

What DOES NOT Require Notification

Not every change in the employment relationship triggers a formal procedure. The following can be done without notification:

  • Salary increase with the same employer in the same position (new in 2026)
  • Change in functional duties within the same role (new clients, new projects — without a position change)
  • Change in employer's address within the same city or voivodeship
  • Reorganisation of the employer without a change of NIP (intra-group merger — only the change of NIP requires notification)

Everything else formally requires notification, and skipping this step is a trap.

What DOES Require Notification

Scenarios in which you are obliged to act:

  1. Change of employer — moving to a different company (different NIP)
  2. Change of position with the same employer ("kierowca" → "menadżer logistyki")
  3. Change of wymiar czasu pracy (full-time to half, or vice versa)
  4. Salary drop below the minimum (4,806 PLN gross in 2026)
  5. Termination of the employment contract without immediate transition to new work

In each of these cases you have 15 working days to notify the voivode. After 15 days, the risk is high that the new employer cannot legally hire you and that the karta pobytu will be annulled.

Powiadomienie o zmianie pracodawcy: Step by Step

Since December 2025 the notification of a change of employer is filed via MOS v2.0 (mos.cudzoziemcy.gov.pl). It is a formal procedure but not equivalent to filing a new karta pobytu.

Step 1. Document gathering. You will need:

  • Scan of the passport
  • Scan of the current karta pobytu (both sides)
  • Umowa o pracę or zlecenie with the new employer (salary at or above 4,806 PLN gross)
  • Załącznik nr 1 from the new employer (questionnaire signed via the employer's Profil Zaufany)
  • Zaświadczenie from ZUS confirming registration (issued in 1 day)

Step 2. Filing in MOS v2.0. Login via your Profil Zaufany. In the section "Sprawy bieżące" → "Powiadomienie o zmianie pracodawcy". Fill in the data of the old and new employer, attach scans.

Step 3. Signature. Sign with Profil Zaufany. Receive a UPO with a notification number.

Step 4. Awaiting confirmation. The voivode reviews the notification within 30–60 days. If acceptable — confirmation sent via eDoręczenia. If not — supplementary documents may be requested or a separate annulment procedure may begin.

The Most Common Mistakes When Changing Employer

Seven years of Warsaw client work surfaces the same failures:

1. Missing the 15-day deadline. Most clients believe they have a "month" or "two months", by analogy with other procedures. The reality: 15 working days from signing the umowa o pracę with the new employer. After that the voivode has grounds to begin annulment.

2. "Grey" work in the gap. Two or three weeks pass between the old job and the new contract. People reason: "I'm in Poland, I have a karta pobytu — I can work informally for now." That is formally an offence and a risk of annulment. Take paid leave, or transition same-day.

3. Filing the powiadomienie via the old employer. Sometimes the old employer offers, "as a favour," to handle the change. That is wrong — the powiadomienie is filed by the foreigner personally through their own Profil Zaufany, not by the employer.

4. Załącznik nr 1 filled in incorrectly. The form requires precise PKD codes, NIP, gross salary, and wymiar czasu. An error in any field — refusal of the powiadomienie.

5. Ignoring eDoręczenia after filing. The voivode may request additional documents (for example, a ZUS RCA report for the first month). A missed request — and the powiadomienie is left without consideration.

What to Do When Work Ends Without a New Job

If your contract has ended and there is no new work in place:

Option 1. You have 15 working days to find a new employer and file the powiadomienie. If nothing is found in that time, the voivode is entitled to start an annulment procedure for the karta pobytu.

Option 2. Apply for a new karta on different grounds. If there is no new job in 15 days but there is a different basis (marriage to a resident, JDG registration, university enrolment), you can file a new karta pobytu on that basis. The old one is annulled, the new one is issued via MOS v2.0.

Option 3. Leave Poland. If no work and no other basis, the only way to avoid annulment is to leave to your country of citizenship (or another visa-free destination) before the 15-day deadline. The card is not annulled on departure, but you cannot work on it without a powiadomienie.

Option 4. Switch to CUKR (Ukrainians with PESEL UKR only). Ukrainian citizens with PESEL UKR have a parallel path. Apply for a karta CUKR — the loss of one employer is not critical because CUKR is not employer-tied.

What to Do If the Card Is Annulled

If the voivode has nonetheless begun the annulment procedure (formal letter "zawiadomienie o wszczęciu postępowania w sprawie unieważnienia decyzji"), you have:

  • 7 days to respond via eDoręczenia, with a justification for why the card should not be annulled
  • 14 days from the annulment decision to file an odwołanie to the Szef UDSC
  • 30 days from the Szef UDSC's decision to file a skarga to the Wojewódzki Sąd Administracyjny in Warsaw

Mazowieckie Pitfalls in 2026

A few specifics to the capital region:

  • Załącznik nr 1 from international employers. Polish branches of multinationals (Deloitte, EY, Accenture, Microsoft Polska) usually know the procedure. But a small company hiring a foreigner for the first time may need legal help with completing the Załącznik.
  • PKD codes must match. The PKD of the new employer's main activity must correspond to your role. An IT specialist cannot work for a company with PKD "Transport drogowy" — the voivode will return the powiadomienie.
  • ZUS registration before filing. If the new employer has not registered you with ZUS before the powiadomienie is filed, expect questions. ZUS first, MOS second.
