What to do if you receive a decyzja odmowna on your karta pobytu in Poland in 2025. Appeal deadlines, common refusal reasons in Mazowieckie, how to draft an odwołanie to the Szef UDSC and a skarga to the WSA. Real success rates.

A decyzja odmowna on a karta pobytu is not a final verdict. The Polish legal system provides three levels of appeal: odwołanie to the Szef UDSC, skarga to the Wojewódzki Sąd Administracyjny, and (in theory) skarga kasacyjna to the Naczelny Sąd Administracyjny. In practice most cases conclude at the second level — but 60–70% of well-prepared appeals overturn the original refusal. The two essentials: don't miss the deadlines, and understand precisely what the urzędnik considered niewystarczające.

Deadlines — The Critical Information

From the moment of doręczenie of the decyzja odmowna via eDoręczenia you have:

  • 14 days for an odwołanie to the Szef Urzędu do Spraw Cudzoziemców (UDSC)
  • 30 days after the Szef UDSC's decision for a skarga to the WSA in Warsaw
  • 30 days after the WSA's wyrok for a skarga kasacyjna to the NSA

"Doręczenie" is not the same as "reading": the 14 days begin from the moment the message is recorded in eDoręczenia as "delivered" (typically 14 days after the first delivery attempt if you do not log in). Check eDoręczenia at least once a week.

Missing the odwołanie by a day — and the decyzja becomes prawomocna, with the karta pobytu refusal final.

Reasons for Refusal — Behind the "niespełnienie warunków" Formula

Every decyzja odmowna contains formal references to articles of the Ustawa o cudzoziemcach with reasoning. Based on our analysis of 200+ cases in Mazowieckie in 2024–2025, the main categories are:

The harshest category is "obejście prawa", where the voivode considers the employment contract or marriage fictitious. Without a lawyer this is nearly impossible to overcome.

Step 1. Analysing the Decision

In the first 24 hours after receipt, read the decision carefully several times. Note:

  • Which articles of the Ustawa o cudzoziemcach the voivode cites
  • Which factual circumstances they consider niewystarczająco proven
  • Which documents they consider niewiarygodne or irrelewantne
  • Whether there are formal procedural errors in the decision text itself

If the Polish legal phrasing is unclear, commission an analysis from a lawyer. Cost 250–400 PLN, 1–2 days. This investment shapes the entire downstream process.

Step 2. Preparing the Odwołanie

An odwołanie is not a free-form complaint. It is a structured legal document containing:

  1. Wstęp — who is filing, against which decyzja, via which voivode
  2. Zarzuty — specific legal claims against the decision (violation of specific KPA articles, błędna interpretacja Ustawy o cudzoziemcach, brak właściwego uzasadnienia)
  3. Uzasadnienie — factual arguments referencing documents in the case
  4. Wnioski — what is requested: uchylenie decyzji or przekazanie sprawy do ponownego rozpatrzenia
  5. Załączniki — new documents supporting your claims

In Mazowieckie in 2025 the odwołanie is filed via the Mazowiecki voivode (the same one who issued the refusal), who automatically forwards it to UDSC. Processing time — 30–60 days.

Step 3. What to Attach

This is the most important part. A simple "I disagree" does not work — you need new documents or new arguments. What works:

  • Clarifying letters from the employer — an expanded Załącznik nr 1 with detailed PKD, duties, conditions
  • ZUS RCA reports — for all months of work, not only the last three
  • PIT-11 from earlier years — if employed in Poland for some time
  • Zaświadczenie o niekaralności — if the voivode questioned trustworthiness
  • Additional accommodation evidence — if refusal was due to inadequate meldunek
  • Witness statements — if the voivode doubted the reality of relationships (marriage, business)

Each document must clearly link to a specific zarzut against the decision.

Step 4. If Szef UDSC Upholds the Refusal

If the Szef UDSC confirms the voivode's refusal (35–40% of cases), the next level is skarga to the Wojewódzki Sąd Administracyjny in Warsaw.

The WSA is a court, not an office, and the rules differ:

  • The skarga is filed via the same voivode who issued the original refusal
  • Deadline: 30 days from doręczenie of the Szef UDSC's decision
  • State fee: 200 PLN
  • Processing time: 6–12 months at the WSA in Warsaw
  • The decision is taken at a hearing, which you may attend in person

Win rates at WSA are higher than at UDSC — around 30–40% versus 25–30%. The court accepts only formal-legal arguments and does not enter into "trust" assessments.

Step 5. What to Do During the Appeal

From the filing of the odwołanie until the final decision:

  • Your legal stay extends automatically — even if the visa or old card has expired. The UPO of your odwołanie has full effect.
  • You may work for the employer named in the original wniosek until final decision
  • Do not leave Poland for extended periods — any departure requires re-entry on a visa or visa-free regime; your legal stay must exist independently of the appeal

If circumstances change during the appeal (new employer, salary increase, JDG registration), this can be used as a new argument. File a "pismo uzupełniające do odwołania".

A lawyer pays for itself by the numbers: with a typical karta pobytu wait of 8–14 months, a fresh filing without an appeal means another 8–14 months. An appeal with a lawyer = 2–4 months to result.

When an Appeal Is Not Worth Filing

Not every refusal warrants an appeal. If you have:

  • Missed the deadline (14 days + an additional 7 for "przywrócenie terminu" is the maximum)
  • Violation of fundamental conditions (no basis, no accommodation, fictitious marriage with clear evidence)
  • Criminal proceedings in Poland or another EU country
  • 2–3 prior refusals on the same basis

In these cases the right move is to invert strategy — change the basis (e.g., from "praca" to działalność gospodarcza), change voivodeship, or leave for the country of citizenship and refile through the consulate.

When You Need a Lawyer — And Which One

Self-filing makes sense if:

  • A simple formal error by the urzędnik (e.g., overlooked ZUS zaświadczenie)
  • Experience reading Polish legal documents
  • Time for office consultations and document gathering

A lawyer is essential if:

  • Refusal was on "obejście prawa" grounds
  • You are filing skarga to the WSA
  • Multiple consecutive refusals
  • Complex family or business situation
  • Uncertain interpretation of articles
