Marriage to a Polish citizen is one of the fastest and most transparent paths to legalisation in the country. Three years after marriage registration you can apply for Polish citizenship; two years after — for karta stałego pobytu without a B1 certificate. The registration procedure for a foreigner differs from that for a Polish citizen: you need an additional document — a zaświadczenie o zdolności do zawarcia małżeństwa (Certificate of No Impediment, CNI) — issued in your country of citizenship.
Documents Required from a Foreigner
For marriage registration in a Polish Urząd Stanu Cywilnego (USC):
- Passport — original + copy of photo page and current visa/karta pobytu page
- Birth certificate — apostilled + sworn translation
- Zaświadczenie o zdolności do zawarcia małżeństwa (Certificate of No Impediment, CNI) — issued in the country of citizenship
- Divorce or death certificate (if previously married) — apostilled + translated
- Current zameldowanie in Poland (if applicable)
- Health certificate (if your consulate requires)
- PESEL — recommended (simplifies USC procedure)
The Polish citizen brings only their dowód osobisty + skrócony akt urodzenia (free from USC).
CNI — The Most Difficult Document
The CNI is an official confirmation from your authorities that you have no impediments to marriage (you are not currently married, you have reached marriageable age, and there is no close family relation to the future spouse).
The procedure for obtaining it depends on the country:
| Country | Where | Time |
|---|---|---|
| Ukraine | civil registry by place of registration or via consulate in Warsaw | 1–3 months |
| Belarus | civil registry or Ministry of Justice in Minsk | 2–4 months |
| Russia | via Russian consulate in Warsaw (politically complicated in 2024) | 3–6 months |
| Kazakhstan | Ministry of Justice in Astana | 2–4 months |
| Georgia | HAUS (House of Justice) in Tbilisi | 1–2 months |
After receiving the CNI — apostille in the country of issue and sworn translation into Polish in Poland.
The CNI has limited validity — typically 3–6 months. Therefore first agree with USC on the registration date, then start obtaining the CNI.
Booking USC and Timing
In Warsaw, marriage registration takes place at the Urząd Stanu Cywilnego of the relevant dzielnica:
- Śródmieście — pl. Bankowy 2
- Mokotów — ul. Rakowiecka 25/27
- Ursynów — al. Komisji Edukacji Narodowej 61
Booking the ceremony via warszawa19115.pl. At least 31 days before the registration date USC must accept your document package for review. The ceremony itself takes 30–45 minutes.
State Fees
- Opłata skarbowa for sporządzenie aktu małżeństwa — 84 PLN
- Opłata for an odpis aktu — 22 PLN (full version) or free (abbreviated)
- Sworn translations of all documents — 50–200 PLN per document
- Apostille in country of issue — 50–100 PLN equivalent
Total registration cost — 250–450 PLN depending on the number of documents and translations.
Ślub Konkordatowy — Church + Civil
If you want a Catholic church ceremony that simultaneously registers the civil marriage (ślub konkordatowy):
- Obtain at USC a zaświadczenie do ślubu konkordatowego (instead of normal registration)
- Go to the parish, hold the ceremony with a priest
- The priest sends to USC the document confirming the ceremony
- After 5 working days — akt małżeństwa is issued
Additionally — pre-marital instruction (nauka przedmałżeńska) at the parish (10 sessions of 1–2 hours) and świadectwo bierzmowania for Catholics.
Effect of Marriage on Legalisation
After marriage to a Polish citizen or PR holder, special legal possibilities open up:
| Legalisation stage | Without marriage | With marriage to Polish citizen |
|---|---|---|
| Karta czasowego pobytu by family | possible with PR resident | possible immediately with citizen |
| Karta stałego pobytu | 5 years of czasowej + B1 | 2 years of marriage + 3 years of czasowego = faster |
| Citizenship | minimum 5+3=8 years | 3 years of marriage + 1 year of stałego = 4 years |
However! USC and the voivodeship have a procedure for detecting "fikcyjnych małżeństw" — marriages contracted purely for karta pobytu without a real family life. If the voivode has doubts, an interview with both spouses separately is scheduled, with checks of cohabitation, photographs, correspondence, bank accounts. The refusal rate when fictitiousness is suspected is 40–60%.
Step-by-Step in Practice
Step 1. Agree with the Polish partner on the wedding, choose USC and date (usually 2–6 months ahead).
Step 2. Request CNI in your country via consulate or relatives. In parallel, obtain apostilles on the birth certificate.
Step 3. Order sworn translations in Poland (as documents arrive from relatives).
Step 4. Submit the package to USC at least 31 days before the ceremony. USC checks for formal completeness.
Step 5. If all is in order — confirmation of the ceremony date arrives. If not — a deadline for uzupełnienie is set.
Step 6. USC ceremony: 2 witnesses (friends are fine), oath, exchange of rings.
Step 7. Receive akt małżeństwa (full version 22 PLN, abbreviated free).
Step 8. Within 30 days, file karta pobytu by family via MOS v2.0.
Most Common Mistakes
- CNI with expired validity — some countries issue 3-month CNIs, while USC requires "aktualne". Order CNI close to the registration date.
- Without apostille or only photocopies — apostille is mandatory. USC does not accept simple photocopies.
- Outdated translations — translations older than 6 months may not be accepted.
- Name mismatches — names in foreign passports may transliterate differently. USC accepts only one form.
- Polish partner unprepared — sometimes Polish partners do not realise they too need zameldowanie and signatures on additional documents.
When You Need a Lawyer
Self-handling works if:
- CNI and apostille in country of issue go through without problems
- The Polish partner has a working dowód osobisty and meldunek
- Time — 4–6 months for document gathering
A lawyer makes sense if:
- Difficulties obtaining CNI (e.g., lost passport in country of issue, political obstacle in RU)
- A foreign divorce involving a non-Polish citizen — additional documents needed
- USC suspicion of fikcyjność
- Karta pobytu or citizenship application in parallel
At LegalWin our civil registry service includes help with CNI, apostilles, translations, and USC accompaniment. From 1,200 PLN.
